Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of Social Auto Mate (the “Service”), operated from Canada. By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Social Auto Mate provides tools to help you create, schedule, and publish content to third-party social and related platforms, using features that may include automation and AI-assisted generation. Features depend on your plan and integrations you enable.

3. Your account

You are responsible for the accuracy of information you provide, safeguarding your login credentials, and all activity under your account. You must be at least the age of majority in your province, state, or country of residence, or have authority to bind the business on whose behalf you use the Service.

4. Acceptable use

You agree not to misuse the Service, including by:

  • Violating applicable law or third-party rights (including intellectual property and privacy)
  • Attempting to probe, disrupt, or gain unauthorized access to our systems or other users’ data
  • Using the Service to distribute malware, harass others, or send unsolicited or unlawful messages
  • Misrepresenting your identity or your affiliation with any person or entity

We may suspend or terminate access if we reasonably believe you have breached these Terms or pose risk to the Service or others.

5. Third-party platforms and services

The Service relies on third-party platforms (such as social networks), APIs, payment processors, analytics, and hosting providers. Your use of those services may be subject to their separate terms and policies. We do not control third-party platforms and are not responsible for their availability, actions, or enforcement (for example, account restrictions or content removal).

6. Content

You are responsible for content you submit and for reviewing content before it is published where applicable. You represent that you have the rights needed to use and publish your content. AI-generated or assisted outputs may be incorrect or inappropriate for your situation—you remain responsible for what you publish.

7. Fees and subscription

Paid plans are billed according to the pricing and checkout flow presented at purchase, processed by our payment provider. Taxes may apply where required. Subscription renewal, cancellation, and refund practices are described in our Refunds & cancellation policy and in-product billing settings where available.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOCIAL AUTO MATE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING APPLICABLE CONSUMER PROTECTION LAWS).

10. Indemnity

You will defend and indemnify us against third-party claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.

11. Changes

We may update these Terms from time to time by posting a new version on this page and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms, except where prohibited by law.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Ontario, subject to applicable mandatory consumer protections in your jurisdiction.
